Renter's Responsibility Agreement

BY RENTING FROM NATIONWIDE KARAOKE IT IS UNDERSTOOD THAT YOU HAVE READ, AGREE WITH AND WILL ADHERE TO THE FOLLOWING:

SONG LIST UPDATES
  • As a RENTER, I AGREE and UNDERSTAND that the SONG LIST is updated regularly and is SUBJECT TO CHANGE AT ANY TIME and therefore:
    • I agree to purchase any "must have" songs as Special Requests if I have any concern they will not be on the system
    • I agree to hold Nationwide Karaoke blameless for any Song List updates that directly affect my rental experience
KARAOKE MUSIC RENTAL & SPECIAL REQUESTS
  • As a RENTER, I AGREE and UNDERSTAND that Special Collections and Song Requests are subject to the following:
    • I agree and understand that any rental of karaoke music from Nationwide Karaoke must accompany an order of a karaoke machine rental package and that karaoke music cannot be rented separately from Nationwide Karaoke
    • I agree and understand that Nationwide Karaoke will make every effort to provide the song I request as performed by the artist I request, but due to availability, may need to substitute my request with a similar alternate version of the same song as performed by a different artist if it is the only version of the song in karaoke format currently made available to Nationwide Karaoke
    • I agree and understand that the policy of Nationwide Karaoke, being a family-friendly company, is to provide the "clean" version of any song requests and will always strive to do so to the best of their ability.
    • I agree and understand that Nationwide Karaoke is not the karaoke manufacturer and does not create the song requests. Therefore, though Nationwide Karaoke will always make every effort to obtain the best version of any song request, I agree and understand that Nationwide Karaoke is not responsible for the quality of the actual recordings or the level of censorship provided within the song requests.
    • I agree and understand that, unlike other companies that only provide basic karaoke music, Nationwide Karaoke will always strive to provide karaoke music with the added feature of a guide vocal option at no additional charge. I agree and understand this extra feature may or may not be available with the karaoke music I rent.
    • I agree and understand that if my special song requests are not available in regular karaoke format that I may request accompaniment track (no screen lyrics) versions, if available, and may indicate this in my order
    • I agree and understand that I will be refunded for any special song requests that cannot be added
    • I agree and understand that selecting featured collections (typically highlighted in yellow) and/or my failure to select the correct amount or type of song collections with my order may require an additional fee that will be deducted from my deposit, accordingly
    • I agree and understand that category section titles (such as: "Decades", "Genres", etc) are not the same at karaoke collection titles in those categories (such as: "50s", "Country", etc) and that if I fail to supply actual karaoke collection titles in time for shipment and delivery for my event, as agreed in these Terms & Conditions, then Nationwide Karaoke will have to select karaoke collection titles for me in the same quantity I ordered and I will be responsible to pay the rental fee for them, accordingly
    • I agree, understand and accept that I am responsible to select the song collection and song request rentals in advance and that failure to select the rental music prior to shipment may result in Nationwide Karaoke needing to select the rental music on my behalf and that I will be responsible to pay the rental fee for the music, accordingly, either in advance and/or deducted from my deposit, as determined by Nationwide Karaoke
    • I agree, understand and accept that due to the "made-to-order" aspect of special song collections and song requests being added a la carte to my order they are therefore non-refundable once my order has been processed
    • I agree, understand and accept that all music provided by Nationwide Karaoke with my rental is for rental use only, is and always will remain the property of Nationwide Karaoke and that any attempt to tamper with or illegally copy the rental music provided may result in additional fees being charged and/or further action
UPGRADES
  • As a RENTER, I AGREE and UNDERSTAND that UPGRADES, such as the PRO Rental, are based on availability at the time of shipment and therefore:
    • I agree and understand that upgrades may or may not be available when my order ships and may be substituted with the standard rental system or option
    • I agree and understand that I will be refunded for the upgrade portion of my order if Nationwide Karaoke is unable to provide the upgrade to my order
    • I agree and understand that upgrades are not guaranteed and that Nationwide Karaoke is under no obligation to provide any upgrades, including, but not limited to, the PRO rental, nor any form of compensation, monetary or otherwise beyond refunding the upgrade portion of my order, should any upgrade happen to be unavailable at the time of shipment

EVENT DATE
  • As a RENTER, I AGREE and UNDERSTAND that it is MY RESPONSIBILITY to enter the CORRECT EVENT DATE:
    • I agree and understand that I must enter the correct event date in writing with my order
    • I agree and understand that even if I fail to enter the correct event date that I will still be bound by these Terms & Conditions and will still be responsible for the rental fees, shipping fees and any other fees associated with my rental order once the rental equipment has been shipped by Nationwide Karaoke
SHIPPING & HANDLING
  • As a RENTER, I AGREE and UNDERSTAND that failure to select the correct shipping option and other factors may result in additional shipping fees:
    • I agree and understand that orders placed after 2p EST will be shipped the following business day: Monday-Friday and may require a shipping upgrade if the wrong shipping option is selected
    • I agree and understand that orders are generally shipped to arrive the business day: Monday-Friday prior to my event date when available or the morning of my event date at the latest. Extra Days may be added in advance to guarantee the arrival date.
    • I agree and understand that the included shipping fee is based on delivery the business day prior to my event date and, if faster shipping is required, a shipping fee adjustment will be deducted from my deposit, accordingly
    • I agree and understand that Saturday deliveries will incur additional S&H fees
    • I agree and understand that my S&H will be upgraded to Priority Overnight Delivery if my event is the day following shipment and that the additional fee will be deducted from my deposit refund, accordingly
    • I agree and understand, regardless of what shipping option I choose, that during the holidays, high-volume seasons or if I fail to select the correct shipping option or fail to place my order in time and/or due to reasons outside of Nationwide Karaoke's control (including, but not limited to, availability at time of shipment, extenuating circumstances, etc.) my order may have to be shipped to arrive the day of my event and that under no circumstances will Nationwide Karaoke be held responsible nor can Nationwide Karaoke control what time of the day my rental order will arrive
    • I agree and understand that the shipping location for my rental may result in a shipping fee adjustment, including an increase in shipping fees deducted from my deposit or charged separately, as needed (this includes, but is not limited to: Alaska, Hawaii, some western and northern states, remote and residential locations, etc. as charged by the shipping courier)
    • I agree and understand that any additional fees charged by the shipping courier (i.e. FedEx, etc.), including but not limited to: address correction fees, redirect fees, special delivery fees, etc. will be deducted from my deposit refund
    • I agree and understand that any additional deposit deductions necessary for shipping expenses will be rounded up to the nearest dollar to help cover the additional handling time necessary to process the fee correction
    • I agree and understand that the shipping fee paid when I placed my order is an estimate and that the actual shipping fee may be greater based on my shipping location, my failure to choose the correct shipping option and/or other factors and that any outstanding shipping and handling balance will be deducted from my deposit, accordingly
    • I agree and understand that once my rental package has shipped, shipping fees are non-refundable under any circumstances including, but not limited to, in the event my rental package is delivered late by the shipping courier due to weather, acts of God, or other shipping courier errors; I, the RENTER, enter or include the wrong address or event date in or with my order; if I cancel my order for any reason or for any other reason.
As a RENTER, I AGREE and UNDERSTAND that I may be charged additional shipping fees if the correct shipping options are not selected and/or in accordance with other factors, as indicated above.

SECURE MY SHIPMENT
  • As a RENTER BY MAIL, I AGREE to be RESPONSIBLE for MY SHIPMENT and, therefore:
    • I understand that I am responsible for securing the package from the courier (i.e. usually FedEx, etc.)
    • I understand that the shipping courier (i.e. usually FedEx, etc.) is authorized to deliver my shipment to the address I provide, even when no one is present, without a signature release
    • I will provide a secure address for the shipping courier (i.e. usually Fedex, etc.) to deliver my package, with or without someone present to receive it
    • I will only provide 1 address with my order and understand that Nationwide Karaoke is not responsible for selecting the wrong address if more than one is provided
    • I understand my rental cannot and will not be shipped to a PO BOX or mailbox service but must be shipped to a physical business or residential address
    • I understand that the shipping courier (i.e. usually FedEx, etc.) may deliver by rental equipment earlier or later than expected and that I am still responsible for securing the rental equipment when it is delivered 
    • I will follow the tracking information from the shipping courier (i.e. usually FedEx, etc.) so that I know when the package will arrive and coordinate securing the package
    • I will review the shipping address I provide with my order and I agree to pay my rental fees in full even if I fail to enter the correct shipping address with my order and, as a result, my rental is shipped to the wrong location
As a RENTER BY MAIL, I AGREE and UNDERSTAND that I must provide the appropriate shipping information to Nationwide Karaoke and that, beyond shipping my package on time, Nationwide Karaoke is NOT RESPONSIBLE for me receiving my package at the address I provide.  As a RENTER BY MAIL, I AGREE and UNDERSTAND that I am responsible for securing my package from the shipping courier (i.e. usually FedEx, etc.) the moment it is shipped by Nationwide Karaoke and will be held COMPLETELY responsible for it including the forfeit of my rental fee, deposit and the cost of replacement if lost, stolen or damaged.

TEST EQUIPMENT IMMEDIATELY
  • As a RENTER, I AGREE to TEST ALL EQUIPMENT IMMEDIATELY when received and therefore:
    • I will take everything OUT of the box I receive and FOLLOW ALL INSTRUCTIONS BEFORE CALLING Nationwide Karaoke with any questions.
    • I will not assume I know what the system looks like, but will FOLLOW THE ENCLOSED CHECK LIST and INSTRUCTIONS to insure all items are present and accounted for
    • I will keep GOOD TRACK of the RETURN LABEL included in my package
As a RENTER BY MAIL,  I AGREE and UNDERSTAND that is is MY RESPONSIBILITY to TEST and INSPECT ALL EQUIPMENT IMMEDIATELY UPON DELIVERY by the shipping courier and FAILURE TO DO SO may prevent all opportunity to receive any necessary assistance and/or replacement of any equipment in the EXTREMELY RARE case that it may be needed. I also understand I am responsible for returning all equipment and failure to return any equipment will result in me being charged a replacement fee, accordingly. I understand I will still be responsible for any equipment not returned, even if I fail to test and make sure all equipment is present when received, as agreed, and therefore, I will make sure all equipment is present and fully functional and notify Nationwide Karaoke by email with any concern, if needed, prior to my event.


USER ERROR RESPONSIBILITY
  • As a RENTER, I AGREE that Nationwide Karaoke is NOT RESPONSIBLE for USER ERROR, including, but not limited to, my INABILITY TO OPERATE any EQUIPMENT they rent to me and/or my inability to operate any equipment I choose to use in conjunction with their equipment, therefore:
    • I AM RESPONSIBLE to FOLLOW THE INSTRUCTIONS closely and carefully and not assume I already know how to operate the equipment
    • I AGREE and UNDERSTAND that I, the RENTER, am FULLY responsible for any equipment I choose to utilize in connection with the rental equipment provided by Nationwide Karaoke, including, but not limited to: TV, PA, sound system, monitor, computer, etc. and that Nationwide Karaoke is NOT responsible for the functionality of any such equipment that I choose to use in conjunction with their equipment and/or my ability/inability to operate such equipment in conjunction with the rental equipment provided by Nationwide Karaoke
    • I AGREE and UNDERSTAND that any suggestions Nationwide Karaoke provides regarding any equipment I choose to use in conjunction with their rental equipment are only suggestions and that I follow them AT MY OWN RISK and that Nationwide Karaoke is NOT responsible for any actions I take regarding such equipment
    • If necessary, I will contact Nationwide Karaoke with any questions I may have MONDAY-FRIDAY 10a-4:30p EST or SATURDAY before 12p/NOON. if they are not immediately available, I will LEAVE a VOICE shipping or EMAIL with the purpose of my call so that Nationwide Karaoke may assist me as soon as possible. 
REPACKAGE EQUIPMENT AS SHOWN AND DIRECTED
  • As a RENTER, I AGREE and UNDERSTAND that it is MY RESPONSIBILITY to REPACKAGE ALL RENTED EQUIPMENT AS RECEIVED and therefore:
    • I will return equipment in original box with original padding (or identical box with equal padding, if original box is damaged, lost, etc), as received
    • I understand that failure to ship my rental return in the same or identical box, both in type and size from shipping courier, may result in additional S&H fees
    • I understand that I am responsible for any additional cost I incur returning my rental, including, but not limited to, additional shipping fees, packaging materials (i.e. box, padding, etc.), gas, parking, etc.
    • I will individually wrap each microphone and each piece of equipment in protective padding, as received
    • I will NOT wrap the cords around the mics or combine cords from different mics, but will wrap each mic cord separately in wide loops and secure, as received
    • I will follow any included return instructions, the return instructions on the FAQ page and the return instructions here in these Terms & Conditions
    • If for any reason shipping courier (i.e. FedEx) does not accept the recycled packaging from the original shipment, I will repackage the equipment the same way in similar packaging that I provide (at my own expense, if necessary) and I understand that Nationwide Karaoke does not reimburse for any additional packing materials required
    • My FAILURE to REPACKAGE the EQUIPMENT AS RECEIVED may result in me being fined a MISPACKAGING FEE.
RETURN SHIPMENT ON TIME
  • As a RENTER, I AGREE that it is MY RESPONSIBILITY to RETURN and SHIP ALL EQUIPMENT BACK to NATIONWIDE KARAOKE ON TIME, therefore:
    • I will RETURN and SHIP ALL EQUIPMENT NO LATER THAN the MAILING DAY (MONDAY-SATURDAY) FOLLOWING MY EVENT DATE (unless I have purchased EXTRA DAYS prior to my event date from Nationwide Karaoke)
    • I AGREE and UNDERSTAND that I Must Ship My Return the MAILING DAY (MONDAY-SATURDAY) Following my Event Date from a STAFFED FEDEX OFFICE PRINT & SHIP CENTER FACILITY, REGARDLESS of the PROXIMITY of the FEDEX STAFFED FACILITY
    • I AGREE and UNDERSTAND that I Must Ship My Return the MAILING DAY Following my Event from a STAFFED FEDEX OFFICE PRINT & SHIP CENTER, REGARDLESS of whether or not I can locate the original FEDEX RETURN LABEL and that Nationwide Karaoke does not provide replacement labels
    • I AGREE and UNDERSTAND that I Must Ship My Return the FEDEX MAILING DAY (MONDAY-SATURDAY) Following my Event, REGARDLESS of whether or not it is a RECOGNIZED HOLIDAY, provided FEDEX is IN SERVICE that day (See FedEx Holiday Schedule - Exempt Holidays include Christmas Day, New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving)
    • I AGREE and UNDERSTAND that DELIVERING MY RETURN PACKAGE to FEDEX AFTER their LAST PICKUP SHIP TIME for MY SHIPMENT TYPE the MAILING DAY following my event will result in me being CHARGED a LATE FEE.
    • I AGREE and UNDERSTAND that FAILURE TO SHIP MY RENTAL EQUIPMENT ON TIME, regardless of who I entrust to do so, WILL RESULT in me being CHARGED a LATE FEE.
    • I AGREE to Pay ALL LATE FEES in FULL and that any and all late fees may be deducted from my Deposit Refund.  
    • I AGREE and UNDERSTAND that my failure to pay any outstanding late fees may result in my account being referred to a collection agency for which I may incur additional fees.
  • As a RENTER, I AGREE that the SHIPPING RECORD provided by the SHIPPER of the package (FEDEX, ETC.) will be the FINAL AUTHORITY to determine if my package was returned on time.
SHIP FROM FEDEX STAFFED FACILITY
  • As a RENTER BY shipping, I AGREE that it is MY RESPONSIBILITY to DELIVER MY RETURN SHIPMENT ON TIME for SHIPMENT NO LATER THAN the MAILING DAY FOLLOWING MY EVENT to an OFFICIAL STAFFED FEDEX FACILITY and therefore:
    • I AGREE and UNDERSTAND that I MUST ship my rental return from a STAFFED, FEDEX facility and that I CANNOT ship my rental return from an alternate carrier (i.e. ups, usps, etc)
    • I AGREE and UNDERSTAND that I CANNOT and WILL NOT Use a DROP BOX to Return My Rental.
    • I will ASK the FEDEX COURIER to SCAN the RETURN LABEL on the package immediately and REQUEST a RECEIPT from the FEDEX FACILITY as PROOF the package was RETURNED ON TIME to the STAFFED FEDEX location to SHIP ON TIME from the STAFFED FEDEX location.  
    • I AGREE and UNDERSTAND that PICK-UP from My Location is NOT INCLUDED with my rental and FEDEX is NOT REQUIRED nor should they be expected to PICK-UP MY RETURN SHIPMENT from MY LOCATION.
    • I AGREE and UNDERSTAND that DELIVERING MY RETURN PACKAGE to FEDEX AFTER their PICKUP TIME for MY SHIPMENT TYPE the mailing day following my event will result in me being CHARGED a LATE FEE.
  • As a RENTER, I AGREE that the SHIPPING/TRACKING RECORD provided by the SHIPPING COURIER (i.e. FEDEX, etc.) will be the FINAL AUTHORITY to determine if my package was returned on time.
EXTRA DAYS
  • As a RENTER, I AGREE and UNDERSTAND that I May Purchase EXTRA DAYS for My Rental to Arrive Early and/or to Avoid LATE FEES and that I Must Adhere to the Following Conditions:
    • I AGREE and UNDERSTAND that EXTRA DAY(S) are NON-REFUNDABLE and MUST BE PURCHASED PRIOR to Nationwide Karaoke SHIPPING RENTAL EQUIPMENT for the event
    • I AGREE and UNDERSTAND that if I Purchase EXTRA DAY(S) the Equipment Will Thereby be Reserved for ME and Not Rented to Another Customer and therefore I Will Be Charged for the EXTRA DAY(S) I Purchase REGARDLESS of Whether or Not I Use Them
    • I AGREE and UNDERSTAND that if I Have Any Questions Regarding EXTRA DAY(S), I Will Ask Them PRIOR to Placing My Order and Once I Order Extra Days They are NON-REFUNDABLE
    • I AGREE and UNDERSTAND that failure to indicate the DATES of the EXTRA DAY(S) I want in my order will result in my EXTRA DAY(S) being added to the end of my rental period
    • I AGREE and UNDERSTAND that failure to provide the DATES for my EXTRA DAY(S) in time may result in additional S&H fees if my EXTRA DAY(S) are prior to my event date
    • I AGREE and UNDERSTAND that I must indicate the DATES of my EXTRA DAY(S) in writing via EMAIL prior to my event date if I fail to indicate the DATES of the EXTRA DAY(S) in my order
PHONE ORDERS
  • As a RENTER, I AGREE and UNDERSTAND that any and all phone orders, whether full or in part, include a phone order fee.
PARTIAL ORDERS
  • As a RENTER, I AGREE and UNDERSTAND that a rental will be reserved for me the moment I place any part of my order, including partial orders, and that I will be responsible for completing my order on time and that failure to do so may require additional shipping and handling fees and/or a cancellation fee if I fail to complete the order in time to ship on time for my event date
  • A a RENTER, I AGREE and UNDERSTAND that if I fail to complete my rental in one payment, i.e. multiple payments, replacement payments, etc., I will be responsible for any non-refundable merchant fees (i.e. PayPal, etc.) for any additional payments made
DAMAGE
  • As a RENTER, I AGREE and UNDERSTAND that any DAMAGE caused to the rental equipment while in my care or as a result of MISPACKAGING is MY RESPONSIBILITY and that I will be FINED ACCORDINGLY.

CARD TAMPERING

  • As a RENTER, I AGREE and UNDERSTAND that the karaoke music I receive with my rental is PROPERTY of NATIONWIDE KARAOKE and is for the current RENTAL USE ONLY. Due to COPYRIGHT VIOLATION, the UNLAWFUL COPYING of the music files provided by NATIONWIDE KARAOKE is STRICTLY PROHIBITED and any indication of card tampering and/or file duplication WILL RESULT IN ME BEING CHARGED a TAMPERING FEE and may result in additional prosecution. I AGREE and UNDERSTAND that Nationwide Karaoke has taken measure to include "trigger alerts" to notify Nationwide Karaoke when cards and/or files have been tampered with. Card tampering includes, but is not limited to:
    • Ripping or removing tape from song cards or song card port/enclosure
    • Removing song cards from the single-card karaoke system
    • Inserting song cards in or accessing song cards by any device other than the karaoke machine provided by Nationwide Karaoke
    • Evidence of file copying, transferring and/or tampering

CLEANING

  • As a RENTER, I AGREE and UNDERSTAND that it is my responsibility to keep the karaoke system clean, as received, and that a CLEANING FEE may be deducted from my deposit for any cleaning necessary. (SEE FAQ for instructions on cleaning the system under "FEES".)
CANCELLATION of RESERVATION
  • As a RENTER, I AGREE and UNDERSTAND that the moment I place my order, whether full or in part, I am reserving rental equipment for my event and therefore I AGREE and UNDERSTAND that:
    • All rental orders, both partial and complete orders, include a NON-REFUNDABLE $35 Cancellation Fee (plus payment gateway fees and S&H fees) if cancelled for any reason
    • If I fail to complete my order and pay only part of the rental fee, I will still be responsible for the full cancellation fee if I choose to cancel my order for any reason or fail to complete my order in time for shipment, as outlined and agreed in the Shipping & Handling section of these Terms & Conditions
    • All Shipping & Handling Fees, Including Any Additional Shipping & Handling Fees, Re-Routing Fees, etc. Charged by the Courier, are NON-REFUNDABLE
    • Canceled Rentals that have already shipped to the renter MUST be shipped for return IMMEDIATELY upon arrival the SAME DAY the rental is received UNOPENED to be eligible for cancellation and the official tracking record of the shipping courier (typically FedEx) is the FINAL authority to determine the correct time and date of return shipment
    • All Processing Fees Charged by the Payment Gateway/Merchant Exchange (i.e. PayPal, Credit Card, etc.) are NON-REFUNDABLE
    • All Refund Expenses paid by Nationwide Karaoke are NON-REFUNDABLE
  • I Agree and Understand that These Fees Will Be Subtracted from My Total Payment if I Decide to Cancel My Rental for Any Reason.
PAYMENT
  • As the RENTER, I AGREE to adhere to these Terms & Conditions in regard to my payment and any associated refunds and/or credits and to pursue all payment related matters directly with and solely with Nationwide Karaoke

  • As the Renter, I AGREE and UNDERSTAND that if I fail to complete my order in one payment, that any additional, non-refundable merchant-exchange fees will be deducted from my deposit
  • As the Renter, I AGREE and UNDERSTAND that any refunds or credits owed for deposit or otherwise will be processed once the rental equipment is returned and received in accordance with the refund schedule stated in these Terms & Conditions. Additional service fees may apply for any additional processing required.
  • As the Renter, I AGREE and UNDERSTAND that, due to the limited refund window allowed by the merchant gateway (i.e. PayPal, credit cards, etc), if I pay my deposit more than 1 month prior to my event date, and/or as deemed necessary by Nationwide Karaoke, my deposit may be refunded and recharged closer to my event date. When the deposit refund is processed any non-refundable merchant fees will be deducted at that time.
  • As the RENTER, I AGREE and UNDERSTAND that in the event of any default, dispute, claim or chargeback made on my payment(s), I will be obligated to pay all collection charges, service fees and/or attorney fees and that, as a result of any arbitration, my payment(s), including, but not limited to, my deposit and any associated credits, may be deemed or rendered non-refundable by Nationwide Karaoke and/or any of the third parties involved (i.e. credit card company, PayPal, etc.).  I, the RENTER, also AGREE and UNDERSTAND that the decision and judgment made by the arbitrating parties (i.e. credit card company, PayPal, etc.) of any dispute or claim made in favor of Nationwide Karaoke will be final and absolute and that no further claims can be made on the same payment(s) by the RENTER.
DEPOSIT REFUND - MAY TAKE UP TO 3 WEEKS to PROCESS (or LONGER THROUGHOUT AND FOLLOWING HOLIDAYS & PEAK SEASONS)
  • As a RENTER, I AGREE and UNDERSTAND that, due to SHIPPING TIME, PROCESSING TIME and OTHER CUSTOMERS BEING SERVED, it may take up to 3 WEEKS (or LONGER THROUGHOUT AND FOLLOWING HOLIDAYS & PEAK SEASONS [like CHRISTMAS, NEW YEAR'S, SUMMER, etc.] and following other popular events) for my DEPOSIT REFUND to be processed by Nationwide Karaoke FROM THE BUSINESS DATE (MONDAY-FRIDAY BEFORE 2p EST) THE RETURNED EQUIPMENT is RECEIVED for processing by NATIONWIDE KARAOKE (so, for example, if the rental return is delivered to Nationwide Karaoke after 2p EST on a Friday it will not be received for processing until the following Monday and will be processed by Nationwide Karaoke generally within 3 weeks [or longer during peak seasons] of that business day with rare exception).  As a RENTER, I AGREE and UNDERSTAND that after the time it may take Nationwide Karaoke to process my rental return, that it may take even longer for PayPal, my credit card company and/or bank to credit the amount back to my credit card or account.  Therefore, as a RENTER:
    • I AGREE to be PATIENT and WAIT AT LEAST 4 WEEKS (or longer during PEAK SEASONS and following MAJOR HOLIDAYS and other popular events) or more from the day I SHIP my rental return before contacting Nationwide Karaoke regarding my DEPOSIT REFUND.
    • I AGREE that LATE FEES, UNPAID RENTAL FEES, S&H FEES, DAMAGE FEES, MERCHANT FEES (Paypal, etc.) etc. may be DEDUCTED from my DEPOSIT and that I will closely read the refund statement for details, review these Terms & Conditions, my order statement, EMAIL correspondence and the shipping courier's (typically FedEx) tracking record for more information.
    • I AGREE and UNDERSTAND that ALL NON-REFUNDABLE MERCHANT FEES (Paypal, etc.) and PROCESSING FEES will be DEDUCTED from my DEPOSIT and/or be CHARGED to my account, accordingly.
    • I AGREE and UNDERSTAND that all deposit refund payments and/or credits will be refunded via the merchant exchange (i.e. PayPal) back to the original source of payment (i.e. credit card, debit card, PayPal account, etc) whenever possible or to a PayPal account, if the original source refund option is unavailable to Nationwide Karaoke for any reason.

EQUIPMENT

  • As a RENTER, I AGREE and UNDERSTAND that all rental equipment is and remains the property of Nationwide Karaoke and failure to return the rental equipment, in addition to forfeiting the rental deposit, may result in the equipment being reported as stolen to the local authorities and my account being forwarded to a creditor for recovery of the equipment itself along with any losses and/or damages.
OTHER REFUNDS
  • As a RENTER, I AGREE with and UNDERSTAND the following:

RENTAL REFUNDS: We offer refunds based on system performance and timely delivery and NOT personal preference, human error nor equipment not being used. The following Rental Refund policy is based on the expectation that the rental equipment should operate as promised and arrive in time for the event as verified by the respective shipping courier, if sent by shipping.  ALL REFUND REQUESTS OR NON-FUNCTION CLAIMS MUST BE SUBMITTED BY PHONE AND BY EMAIL IMMEDIATELY. IMPORTANT: PHONE IS NOT ENOUGH. THERE MUST BE A WRITTEN EMAIL RECORD to VERIFY COMMUNICATION.

  • We individually inspect each piece of equipment and literally triple test it before it is sent out to insure it is fully operational and again when it is returned. In the event you receive equipment that does not work properly we will gladly send you a replacement or provide an alternative in time for the event ONLY IF YOU NOTIFY US IMMEDIATELY by BOTH PHONE AND EMAIL (THROUGH OUR CONTACT PAGE). We typically send the equipment to arrive NO LATER than the business day prior to the event date so you have time to inspect it and contact us if you have any concerns. YOU MUST TEST ALL EQUIPMENT IMMEDIATELY and CONTACT US by BOTH PHONE AND EMAIL (THROUGH OUR CONTACT PAGE) by 5pEST the same day you receive the equipment if you have any concerns. Any non-functional equipment must be shipped back to us the SAME DAY IT IS RECEIVED if received BEFORE the EVENT DATE and WITHIN 2 HOURS OF RECEIVING THE EQUIPMENT if received ON the EVENT DATE, as evidenced by the shipment record.
  • If the rental equipment works when received, but ceases to function properly during you event, we will refund 50% of the rental fee for that piece of equipment. Again, all equipment must still be returned on time. Any late fees will still apply. Upon inspection and verification of equipment failure and confirmation that there was no human error or mistreatment to the equipment, we will refund 50% of the rental fee for that piece of equipment minus shipping and merchant exchange fees.
  • We always ship on time, guaranteed express delivery. We will generally ship the rental equipment to arrive the business day before the event. In rare cases (high volume seasons, etc.), we may need to ship the rental to arrive the day of the event. If we fail to notify you by phone or EMAIL that we are unable to ship the rental equipment in time to arrive by the event date, we will refund the entire payment 100% and give you 50% off your next rental with us.
  • If any equipment is missing from the order, we will overnight a replacement, provide an alternative solution and/or refund that portion of the order.
  • We do not give refunds for equipment that works as advertised but for whatever reason the client is unable to operate, does not prefer or does not use. Our systems are very easy to use and we include easy to follow instructions. We are also available to answer any questions you may have regarding operation during normal business hours, Monday-Friday, and on emergency call during the weekend. It is YOUR RESPONSIBILITY to test the rental equipment and learn how to use it as soon as you receive it and not wait until the time of the event. Our karaoke systems are designed to serve a wide variety of people and situations and, apart from available song requests, cannot be specially catered to fit the preferences of each individual or group.
  • Rental Fees, Special Song Requests and Collections, Rental Preparation Services, Shipping & Handling Fees and Merchant Fees are separate.  Unless otherwise specified in this agreement, Special Song Requests and Collections, Rental Preparation Services, Shipping & Handling Fees and Merchant Fees are NON-REFUNDABLE.
FREE SONG COLLECTION PROMOTION (WHEN AVAILABLE)
  • As a REPEAT RENTER, I UNDERSTAND and AGREE that the Free Song Collection promotion is for REPEAT CUSTOMERS ONLY whose account is in GOOD STANDING, is not guaranteed, is subject to change at any time and includes the following restrictions:
    • As a Repeat Renter, I agree and understand that I must send Nationwide Karaoke a separate EMAIL following the placement of my order listing the desired standard karaoke collection and requesting the song collection credit
    • As a Repeat Renter, I agree and understand The song collection credit is based on and will only be applied to the actual cost paid by me and or actual value as determined by Nationwide Karaoke for the least expensive collection rented including Bulk collections
    • As a Repeat Renter, I agree and understand that Featured song collections are NOT included in this promotion and that I will not receive a song collection credit for any Featured song collections
    • As a Repeat Renter, I understand that the song collection credit is solely determined by Nationwide Karaoke and that Nationwide Karaoke is not obligated to refund me the song collection credit
    • If the rental equipment is returned late, damaged or requires maintenance, additional cleaning, etc. or in any way is in violation of these Terms & Conditions, I understand that I forfeit my right to any song collection credit and will not receive one
    • As a Repeat Renter, I agree and understand that in order to be eligible for the song collection credit my rental account must be deemed in "good standing" as solely determined by Nationwide Karaoke with no outstanding balance owed and no Terms & Conditions violations
    • The return song collection credit cannot be applied in any other way or for any other purpose, it has no separate or additional monetary value and can only be applied in accordance with these Terms & Conditions and as determined by Nationwide Karaoke
  • i understand that the song collection credit is not guaranteed, that Nationwide Karaoke is not obligated to provide the song collection credit and that Nationwide Karaoke may choose to cancel or refuse to pay the song collection credit at any time and for any reason as deemed necessary by Nationwide Karaoke
RETURN SHIPPING CREDIT PROMOTION (WHEN AVAILABLE)
  • As a RENTER, I AGREE that the Return Shipping Credit promotion is not guaranteed, is subject to change at any time and includes the following restrictions:
    • As the Renter, I must rent 3 or more karaoke music collections to be eligible to receive a return shipping credit
    • As the Renter, I agree that I must send Nationwide Karaoke a separate EMAIL following the placement of my order requesting the shipping credit
    • The return shipping credit is based on the actual shipping costs Nationwide Karaoke paid for me, the renter, to use the included return shipping label to ship Nationwide Karaoke's rental equipment to Nationwide Karaoke
    • As the Renter, I understand that the return shipping credit amount is solely determined by Nationwide Karaoke and that Nationwide Karaoke is not responsible for any additional return shipping related costs I incur, including, but not limited to: gas and travel costs, packaging costs, additional shipping fees, etc.
    • The return shipping credit is only valid if the included return shipping label is used to return Nationwide Karaoke's rental equipment and only for the cost of using that return label, as calculated by Nationwide Karaoke, and is NOT valid for any other return shipment method
    • As the Renter, I am responsible to secure the return shipment label received with my rental and understand that it cannot be replaced if lost or misplaced and that I will not receive the return shipping credit if the original included return shipping label is not used to return the rental equipment
    • If the rental equipment is returned late, damaged or requires maintenance, additional cleaning, etc., I understand that I forfeit my right to a return shipping credit and will not receive one
    • The return shipping credit cannot be applied in any other way or for any other purpose, it has no separate or additional monetary value and can only be applied in accordance with these Terms & Conditions and as determined by Nationwide Karaoke
  • i understand that the return shipping credit is not guaranteed, that Nationwide Karaoke is not obligated to provide the return shipping credit and that Nationwide Karaoke may choose to cancel or refuse to pay the return shipping credit at any time and for any reason as deemed necessary by Nationwide Karaoke

ADDITIONAL FEES

As a RENTER, I AGREE and UNDERSTAND that additional fees may apply to my order and will be deducted from my deposit or charged to my account when my deposit is insufficient to the cover the fees owed. These fees may include but are not limited to: 

SHIPPING FEES:

As a RENTER, I AGREE and UNDERSTAND that, if I fail to select the correct shipping amount with my order or if faster shipping is required to arrive the business day before my event and/or on time for my event, the SHIPPING & HANDLING BALANCE will be DEDUCTED from my DEPOSIT REFUND, accordingly:

In addition to the basic round-trip shipping fee for 3 day delivery, the following minimum upgrade balances will be charged when required:

    2 Day Delivery: $5
    Overnight Delivery: $25

S&H will automatically be upgraded when required and the balance charged or deducted, accordingly. The actual amount may be greater based on the delivery location. See "Shipping & Handling" above.

As a RENTER, I AGREE and UNDERSTAND that if my order requires a SATURDAY DELIVERY that FedEx automatically upgrades the delivery to Priority Delivery and adds a Saturday Delivery fee that will both be DEDUCTED from my DEPOSIT REFUND, accordingly.

CANCELLATION/RESERVATION FEE: $35 (+ All Payment Gateway Fees + All S&H Fees Charged by the Courier)

LATE FEE: $35/Day, $45/Day (During Holiday and High Volume Seasons: May, June, July, August, October, December)

MISPACKAGING FEE: $35

DAMAGE/REPLACEMENT FEE: $25-$125 Duet Microphone, $250 Main Microphone/Karaoke System, $200 Song Card, RCA extension cable $20, RCA coupler(s) $5

RESCHEDULING FEE: $15

RUSH FEE: $25

PHONE ORDER FEE: $5

CARD TAMPERING FEE: Varies (See "CARD TAMPERING" section in these Terms & Condtiions)

NON-REFUNDABLE MERCHANT GATEWAY FEES (i.e. PayPal, Credit Cards, etc): Varies (as described within these Terms & Conditions)

SERVICE FEES: Varies

JURISDICTION

As a RENTER, I AGREE and UNDERSTAND that the jurisdiction for all transactions made with Nationwide Karaoke shall be governed and decided within the state of Florida if and when they are not already governed and decided by the authoritative entities directly involved with the transactions (i.e. credit card providers, PayPal, etc.).

COMMUNICATION

As a RENTER, I AGREE and UNDERSTAND that the EMAIL address provided in my order will be considered the official EMAIL address for communication regarding my order and that I am responsible for checking this EMAIL address regularly and making sure Nationwide Karaoke can communicate with me through this EMAIL address by replying to all EMAILs received regarding my rental.

As a RENTER, I AGREE and UNDERSTAND that I must send notice of any rental updates or changes needed and/or any rental concerns to Nationwide Karaoke via EMAIL through the Nationwide Karaoke contact page and that I must reply by EMAIL directly to EMAIL correspondence from Nationwide Karaoke, in addition to any voice shipping messages I may choose to leave, so that there is a written record of communication. 

As a RENTER, I AGREE and UNDERSTAND that, in the case of rental updates, changes and/or concerns and for post-rental communication, Nationwide Karaoke will conduct communication via EMAIL so that there is a written record of communication and I will make sure that Nationwide Karaoke has my correct EMAIL address and that the Nationwide Karaoke EMAIL is not blocked by my EMAIL account so that communication can take place. 

As a RENTER, I AGREE and UNDERSTAND that Nationwide Karaoke will not be held responsible if I fail to communicate via EMAIL or fail to receive EMAIL communication from Nationwide Karaoke and will therefore confirm that communication has been received and can be received.

AGREEMENT UPDATES

As a RENTER, I AGREE and UNDERSTAND that this agreement is subject to change at any time and that I will be bound to it accordingly.
